Adoptions And Stepparent Adoptions

As American families have become more diverse, family law has followed suit. There are a variety of family situations that may call for adoption. Family units now involve single caregivers, extended family, unmarried couples and same-sex couples. With unmarried couples, a caregiver who is not a child's biological parent may want to formally assume a role. With same-sex couples, only one partner may be the biological parent, thus necessitating the other partner to petition for adoption of the child.

Under Pennsylvania law, generally any adult person may petition the court for adoption. In some situations, a minor may also petition for adoption, such as an older sibling. State law also allows certain adults to be adopted. This may apply in a stepparent situation. If the adopted individual is over 12 years of age, the court will require the individual's consent before approving the adoption.

Yet even with a child under the age of 12, a court may inquire into his or her opinion. As with custody determinations, the court may analyze the adoption request using factors related to the best interest of the child. We will help you find a solution that is right for you and your family.
